Introduction & Acceptance of Terms

Welcome to Kulvaibhav. These Terms of Use govern your access to and use of the Kulvaibhav website, marketplace services and related online services when you act as a buyer or customer.

For these Terms, “Kulvaibhav”, “we”, “us” and “our” refer to Kulvaibhav and, where applicable, its operating entity, Marvello Origin Works Limited. “You”, “your”, “buyer” or “customer” means the person accessing the platform or purchasing products through it.

By using the platform, creating an account, submitting an order or otherwise accessing our services, you agree to these Terms. If you do not agree, you should not use the platform or place an order.

These Terms should be read together with the Privacy Policy, Cookie Policy, Shipping Policy, Returns & Refunds Policy, Cancellation Policy, Exchange Policy, Authenticity Policy and other applicable policies displayed on the website.

About Kulvaibhav

Kulvaibhav is an online marketplace focused on India’s handcrafted and artisan heritage.

The platform may feature handmade clothing, handloom textiles, traditional Indian products, home and living products, décor, cultural products, accessories, artisan-made products, handcrafted goods and other products offered by participating sellers.

Kulvaibhav may work with independent artisans, craftsmen, manufacturers, designers, sellers, brands, workshops and other suppliers. The identity of the seller may be displayed on the applicable product or order page.

Depending on the transaction, the seller may be responsible for fulfilment in accordance with applicable platform requirements and law. Kulvaibhav may provide product discovery, seller listings, shopping-cart functionality, order processing, payment facilitation, customer communication, shipping coordination, returns support, refunds and grievance handling.

Eligibility to Use the Platform

You may use Kulvaibhav only if you are legally capable of entering into a binding agreement under applicable law.

If you are under the applicable age of majority, you should use the platform only with the involvement and supervision of a parent or legal guardian where required.

By using the platform, you represent that the information you provide is accurate, you have authority to use the account or payment method provided, you will comply with applicable laws, you will not misuse the platform and you will not use another person’s identity or credentials without permission.

Kulvaibhav may restrict or suspend access where we reasonably believe an account is being used unlawfully, fraudulently or in violation of these Terms.

Creating & Managing Your Account

Certain features may require a Kulvaibhav account. You may be asked for your name, email address, mobile number, delivery address, billing information, account credentials and other information required for the service.

You are responsible for keeping account information accurate and current. You should keep credentials confidential, use a secure password where applicable, notify us of suspected unauthorised access, avoid sharing your account with unauthorised persons and never create accounts for fraudulent purposes.

You are responsible for activity carried out through your account to the extent permitted by applicable law. Kulvaibhav may require additional verification for certain transactions where necessary for security, fraud prevention or payment processing.

Shopping on Kulvaibhav

You may browse products and add eligible products to your shopping cart. Product pages may contain product name, description, photographs, materials, dimensions, colour, variants, seller information, price, availability, delivery information and return eligibility.

You should carefully review product information before placing an order. Product photographs are intended to represent the product; actual colour may vary because of lighting, photography, screen settings, device display, natural materials and artisan processes.

Product availability may change without notice. Adding a product to your cart does not guarantee that it will remain available until checkout or payment.

Product Information & Artisan-Made Variations

Kulvaibhav features products that may be handmade, handcrafted, handloom or artisan-produced. Such products may naturally exhibit variations in colour, texture, weave, dimensions, embroidery, pattern, stitching, natural marks, grain and finishing.

Where a product has specific care, usage or material requirements, those requirements should be reviewed before purchase.

Prices, Taxes & Charges

Product prices displayed on Kulvaibhav should be reviewed before placing an order. Depending on the transaction, the total amount may include product price, applicable taxes, shipping charges, handling charges, disclosed platform or service charges, discounts, promotional adjustments and other applicable charges.

Where applicable, taxes and charges should be displayed or communicated as required by law. Prices may change from time to time.

A price change will generally not alter an order that has already been validly accepted, except where correction or adjustment is permitted or required by law or where there has been an obvious pricing or technical error. If an obvious error occurs, Kulvaibhav may contact you before fulfilling the affected order.

Orders & Order Acceptance

Submitting an order constitutes a request to purchase the selected product. After placing an order, you may receive an acknowledgement or confirmation. An acknowledgement does not necessarily mean final acceptance if additional verification or seller confirmation is required.

An order may be cancelled or declined because of product unavailability, incorrect inventory information, pricing or listing errors, suspected fraud, payment failure, delivery restrictions, seller inability to fulfil, violation of applicable terms or other legitimate circumstances.

Where an order is cancelled after payment has been received, the applicable amount should be handled through the applicable refund process and law.

Payments & Transaction Processing

Kulvaibhav may support payments through third-party payment service providers. Available methods may include debit cards, credit cards, UPI, net banking, wallets, other digital methods and other methods displayed at checkout.

Payment information may be processed by authorised payment providers. Where payment processing is handled by a third party, Kulvaibhav may not directly store complete payment-card credentials.

You agree to provide valid payment information and use only payment methods you are authorised to use. Transactions may be subject to authentication, fraud screening, bank verification, provider requirements and applicable financial regulations. If payment fails, the order may not be processed until successful payment is received.

Shipping & Delivery

Products may be delivered to eligible addresses through sellers, shipping partners or other logistics providers. Estimated delivery timelines may appear on the product page, checkout, order confirmation or later communication.

Delivery estimates are generally estimates rather than guaranteed dates unless expressly stated otherwise.

Delivery may be affected by seller processing time, product availability, location, courier capacity, weather, natural events, public holidays, regulatory restrictions, incorrect addresses, remote locations, transportation disruptions or other circumstances beyond reasonable control.

You are responsible for providing an accurate delivery address and contact information. Repeated failed delivery attempts or an incorrect address may have consequences under the applicable Shipping Policy.

Returns, Exchanges & Refunds

Returns, exchanges and refunds are governed by the applicable Returns & Refunds Policy, Exchange Policy and product-specific terms displayed at purchase.

Eligibility may depend on product category, seller policy, product condition, return window, reason for return, customisation, hygiene requirements, perishability, made-to-order status and applicable law.

Where a return is permitted, the product may need to be unused, undamaged, complete and returned within the specified period. Certain customised, personalised, made-to-order, hygiene-sensitive or perishable products may be non-returnable where lawfully permitted.

Cancellations

You may request cancellation of an order in accordance with the applicable Cancellation Policy. Availability may depend on order status.

Cancellation may not be possible after production has commenced, customisation has commenced, dispatch has occurred or another irreversible fulfilment stage has occurred.

Where cancellation is accepted, any eligible refund will be processed according to the applicable policy. If Kulvaibhav or a seller cancels an order because of unavailability, inability to fulfil, payment problems or another legitimate circumstance, amounts paid should be handled according to the applicable refund process and law.

Product Authenticity & Handmade Nature

Kulvaibhav aims to support authentic handcrafted and artisan-made products. Where a listing identifies a product as handmade, handloom, artisan-made, handcrafted, traditional or culturally significant, buyers should review the description carefully.

Because handmade products are often individually or traditionally produced, minor differences between pieces may occur. Kulvaibhav may establish seller and listing requirements designed to support accurate product information.

Where a specific authenticity certification, geographical indication, hallmark, material certification or other certification is claimed, the relevant listing should identify the applicable information where required. Buyers should not assume that every handmade product carries a particular certification unless the listing expressly states it.

User Responsibilities

When using Kulvaibhav, you agree to provide accurate information, use the platform lawfully, maintain account security, use valid payment methods, provide accurate delivery information, inspect products according to applicable return procedures, communicate respectfully, follow return and shipping instructions, provide truthful complaint information, avoid fraudulent transactions and comply with these Terms and applicable policies.

You should not intentionally create repeated orders you do not intend to complete, abuse promotional offers or otherwise interfere with normal marketplace operations.

Prohibited Activities

You must not use Kulvaibhav to:

• Commit fraud or impersonate another person.
• Provide false information or use another person’s payment method without authorisation.
• Create fraudulent accounts or manipulate reviews or ratings.
• Abuse return, refund or promotional systems.
• Exploit technical vulnerabilities or introduce malware.
• Scrape or systematically copy protected website content without permission.
• Interfere with platform security or attempt unauthorised access.
• Reverse engineer protected systems where prohibited by law.
• Use automated systems to disrupt the platform.
• Conduct unlawful transactions or infringe intellectual property rights.
• Harass sellers, artisans, employees or support personnel.
• Circumvent security controls or otherwise misuse the platform.

Kulvaibhav may investigate suspected misuse and take appropriate action, subject to applicable law.

Intellectual Property

The Kulvaibhav website and its content may contain logos, trademarks, photographs, product images, text, graphics, designs, videos, software, layouts, interface elements, databases and other intellectual property.

Unless otherwise stated, these materials belong to Kulvaibhav, its licensors, sellers, artisans, partners or other rights holders.

You may use the website for legitimate personal shopping purposes. You may not reproduce, distribute, modify, commercially exploit or otherwise use protected content without appropriate permission, except where permitted by applicable law.

Seller and artisan intellectual property remains subject to the rights of the relevant owner.

Third-Party Services & Links

Kulvaibhav may use or link to third-party services including payment providers, logistics providers, analytics services, customer-support systems, social-media platforms, authentication providers, embedded content, external websites and other technology services.

Third-party services may operate under their own terms and privacy policies. Kulvaibhav is not responsible for independent third-party websites or services to the extent permitted by law.

You should review applicable third-party terms before using an external service.

Reviews, Ratings & User Content

Kulvaibhav may allow buyers to submit product reviews, ratings, photographs, comments, feedback and other user-generated content.

Submissions should be truthful, based on genuine experience, relevant, lawful, non-defamatory, non-threatening, non-infringing and free from malicious content.

You should not post fake reviews, reviews submitted for undisclosed compensation, another person’s private information, fraudulent claims, unlawful material, copyrighted material without permission or content intended to manipulate ratings.

By submitting content, you grant Kulvaibhav the permissions necessary to host, display, reproduce and use that content for platform and business purposes, subject to applicable law and our Privacy Policy. We may remove content that violates applicable rules or these Terms.

Promotions, Offers & Discounts

Kulvaibhav may provide promotional codes, discounts, seasonal offers, loyalty benefits, special campaigns, limited-time offers, shipping promotions and other promotional benefits.

Each promotion may have separate terms and may include conditions relating to minimum order value, eligible products, eligible users, usage limits, validity periods, payment methods, geographic availability or other restrictions.

Unless expressly stated otherwise, promotional benefits may not be combined. Kulvaibhav may withdraw or modify a promotion where permitted by its terms and applicable law.

Promotions must not be used fraudulently or through multiple accounts created to circumvent restrictions.

Privacy & Personal Information

Platform Availability & Technical Issues

Kulvaibhav aims to keep the platform available and functional, but uninterrupted availability cannot always be guaranteed.

The platform may occasionally be unavailable because of maintenance, upgrades, technical failures, hosting or network problems, cybersecurity incidents, third-party service interruptions, power or telecommunications failures or circumstances beyond reasonable control.

We may modify, suspend or discontinue particular website features where reasonably necessary. If a technical error affects an order, payment or transaction, we will seek to resolve the matter in accordance with applicable procedures and law.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Kulvaibhav platform is provided subject to its available functionality and applicable terms.

We do not guarantee that every product will always be available, the website will always be uninterrupted, every product image will appear identical on every device, estimated delivery dates will always be achieved, third-party services will always function without interruption or the website will always be free from technical errors.

Product-specific representations made by a seller remain subject to applicable law and the applicable product listing and policies.

Limitation of Liability

To the maximum extent permitted by applicable law, Kulvaibhav will not be liable for indirect, incidental, special or consequential losses arising from use of the platform where such limitation is legally permitted.

Nothing in these Terms limits liability that cannot lawfully be limited or excluded. This may include liability arising from fraud, wilful misconduct, legally non-excludable consumer rights, statutory obligations or other circumstances where applicable law prohibits limitation.

Where Kulvaibhav acts as a marketplace intermediary, liability may also depend on the specific role performed by Kulvaibhav in the relevant transaction.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Kulvaibhav and its relevant officers, employees, representatives and service providers from claims, losses, liabilities and reasonable expenses arising from your unlawful use of the platform, violation of these Terms, fraudulent activity associated with your account, infringement of another person’s rights, misuse of promotional benefits or content you submit that violates applicable rights or law.

This provision will not require you to indemnify Kulvaibhav for matters caused by Kulvaibhav’s own unlawful conduct to the extent such liability cannot legally be transferred to you.

Suspension & Termination

Kulvaibhav may suspend or restrict an account where reasonably necessary because of suspected fraud, security concerns, unlawful activity, misuse of the platform, repeated abuse of policies, violation of these Terms, payment-related abuse, promotional abuse or other legitimate reasons.

Where appropriate and legally required, we may provide notice or an opportunity to address the issue.

You may stop using your account at any time, subject to outstanding orders, transactions, refunds, disputes or legal obligations. Termination or suspension does not automatically cancel obligations that arose before termination.

Certain provisions may continue after account closure, including provisions concerning intellectual property, payments, liability, indemnification, disputes, privacy, records and provisions intended by their nature to survive.

Changes to These Terms

Kulvaibhav may update these Terms from time to time because of changes in our marketplace, new features, business practices, applicable law, payment or delivery arrangements, seller relationships or policy improvements.

The updated version will be published on the website with an updated Last Updated date. Where required by applicable law, significant changes may be communicated through an appropriate notice mechanism.

Your continued use of the platform after an updated version becomes effective may constitute acceptance of the revised Terms to the extent permitted by applicable law. If you do not agree with revised Terms, you should stop using the platform.

Governing Law & Jurisdiction

These Terms are intended to be governed by the laws applicable in India, subject to mandatory consumer-protection rights and other applicable laws.

Any dispute arising in connection with these Terms or your use of Kulvaibhav will be subject to the dispute-resolution mechanisms and jurisdiction available under applicable Indian law.

Where appropriate, Kulvaibhav may attempt to resolve complaints and disputes through its internal grievance-redressal process before formal proceedings are initiated. The applicable consumer forum, court or other competent authority will be determined in accordance with applicable law.
